Pre-Nuptial & Post-nuptial Agreements

Pre-Nuptial Agreements are also referred to as Pre-Marital Agreements and can be prepared pre-marriage (before) or post-marriage (after). They can also be prepared for couples entering into Civil Partnership.

Pre-Nuptial Agreements are also referred to as Pre-Marital Agreements and can be prepared pre-marriage (before) or post-marriage (after). They can also be prepared for couples entering into Civil Partnership.

They can give you peace of mind if, for example:

  • You want to protect inheritance or future inheritance;

  • There is a significant disparity in your wealth, and you want to protect your assets;

  • You have children from a previous relationship and want to ensure certain assets are preserved for them;

  • You own a business which you would want to protect if the marriage were to break down; or

  • Your spouse or civil partner to be has significant debt which you would not want to be liable for.

A Pre-Nuptial Agreement is a written document that sets out your joint understanding of what will happen to your finances if the marriage or civil partnership comes to an end. It is very important that both parties take their own independent legal advice in relation to any agreement and that the advice is received as far ahead of the marriage or civil partnership as possible, ideally at least a few months before the ceremony.

A Pre-Nuptial Agreement is not automatically enforceable, however, the Supreme Court has given recognition to them.  The Law Commission is also pressing for new legislation surrounding the recognition of Pre-Nuptial Agreements.  In many cases they can serve to influence the outcome of financial settlements and thus provide the highest level of reassurance and protection that is currently available.
