Domestic Abuse | Injunctions
There is law in place to help and protect you if you are a victim of domestic abuse. We understand that domestic abuse is unconnected to gender and that both men and women can be victims.
An injunction can afford you the security and peace of mind that you, your family and your property are protected when a relationship breaks down. An injunction is a Court Order that compels someone to do, or not to do, something. The threshold (test) applied by the Court is high, and our considerable experience in this area enables us to provide realistic advice to you as to your likely prospects of success, both at the outset and throughout the duration of your matter.
A Non-Molestation Order
A Non-Molestation Order is aimed at preventing your partner or ex-partner from using or threatening violence against you, intimidating, harassing or pestering you. The purpose of a Non-Molestation Order is to ensure your health, safety and well-being as well as, if applicable, your child or children. An automatic power of arrest attaches to all Non-Molestation Orders, meaning that if your partner or ex-partner breaches any of the terms, they will have committed a criminal offence, for which they can be immediately arrested.
An Occupation Order
An Occupation Order regulates who can live in the family home, and can also restrict your partner or ex-partner from entering or attending the property, or even from entering the surrounding area.
Applications for both Non-Molestation Orders and Occupation Orders can be made to the Court on an urgent basis (sometimes the same day and without any notice to your partner or ex-partner) if the circumstances are serious enough to warrant such a course of action.
